Terms & Conditions

This agreement governing the terms and conditions of your use of the Dandy Cans LLC trash can cleaning services, is between you (“you” or “customer”), as an authorized user of such services, and Dandy Cans LLC (“service provider” or “Dandy Cans”).

 

This agreement, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Dandy Cans (collectively, the “agreement”), constitutes the entire agreement between Dandy Cans and you regarding the Dandy Cans cleaning service. By using the service, you confirm your acceptance of, and agree to be bound by, this agreement.

 

Service

The service is a trash can cleaning service or pressure washing service that is agreed on, by you and Dandy Cans. There are no contracts or obligation by either party. Your service plan that you choose will renew automatically after each period of time and cleaning is performed. Dandy Cans will continue to provide their services and send an invoice after each service is performed until written cancelation is received by mail or email.

 

Customer Responsibilities

In order for Dandy Cans LLC to provide its service YOU MUST ABIDE BY THE FOLLOWING CONDITIONS or service could be interrupted or postponed.

A. Trash can(s) must be left out at their collection site and easily accessible to service personal on scheduled day.

B. Trash can(s) must be free of excessive cooking / motor oil or un-bagged animal waste.

C. Trash can(s) must be free of chemicals, fresh paint, glue or other adhesive, or hazardous waste of any kind.

D. Trash can(s) must be free of building materials, e.g. plaster, stucco or concrete.

E. Trash can(s) must be completely empty. If any of the above conditions exist and prevent Dandy Cans from providing their service on a scheduled service day there will be a $20.00 charge with explanation on that month’s invoice.

 

Dandy Cans responsibilities

If Dandy Cans fails to provide its service on the scheduled day of service for any reason other than the customer failing to meet their responsibilities in the above paragraph, e.g. weather, or illness. Dandy Cans will send out an email to the customer with explanations and a proposed reschedule date.

 

Modifications to Customer Agreement

Dandy Cans may amend this agreement at any time by (A) posting a revised Customer Agreement on our website at www.dandycans.com, and or (B) mailing or emailing information regarding the amendments to the customer. We welcome all inquiries, questions and comments regarding any changes made to the agreement from our clients. Our goal is to always serve our customers to the best of our ability and any changes to the agreement would be solely made for the betterment of the service program.

 

Modifications to Service

Dandy Cans reserves the right to modify our delivery of service for the betterment of our clients and the overall success of the service program. The customer reserves to right to change service plans at any time for any reason.

 

Charges

Customer agrees to pay all charges for your use of the service at the price agreed upon during initial sign up and selection of the service plan of your choice. Dandy Cans reserves the right to change prices or institute new charges for access to or use the service. Any changes in prices will be communicated to the customer by telephone, mail, or email. Continued use of the service or non-termination of your Dandy Cans account after changes have been communicated to you by telephone, mail, or email correspondence constitutes your acceptance of the price modified by the posted changes. A. Payment for your Dandy Cans service is due in accordance with your cycle of payment and must be made within ten days of service being provided, by a credit or debit card designated to you, qualified check, PayPal, or cash. B. Charges will be billed based upon your agree payment schedule for the service plan that you have selected. If payment by credit card is not fulfilled or honored by the issuer of your credit or debit card, you agree to pay all amounts due upon demand by Dandy Cans. C. Your service is recurring based upon the service plan that you selected. You may opt out at any time, as long as notice is given via email at dandycans@gmail.com, or written notice is received at PO Box 36 Pollock Pines, CA 95726, before the next scheduled service date. D. Dandy Cans reserves the right to suspend or terminate your service without notice upon rejection of any credit or debit card charges or if your card issuer seeks return of payments previously made to Dandy Cans, when Dandy Cans believes that you are liable for the charges. Such rights are in addition to, and not in lieu of, any other legal rights or remedies available to Dandy Cans.

 

Miscellaneous

A. The failure of either party to enforce its rights under this agreement at any time for any period shall not be construed as a waiver of such rights.

B. If any part, term or provision of this agreement is held to be illegal or unenforceable neither validity nor enforceability of the remainder of this agreement shall be affected.

C. Neither party shall assign or transfer all or part of its rights under this agreement without the consent of the other party.

D. This agreement constitutes the entire understanding between the parties relating to the subject matter hereof unless any representation or warranty made about this agreement was made fraudulently.

E. Neither party shall be liable for failure to preform or delay in preforming any obligation under this agreement, if the failure or delay is caused by any circumstances beyond its reasonable control, including but not limited to acts of God, war, civil commotion or industrial dispute, or fire. If such delay of failure continues for at least 30 days, the party not affected by such delay or failure shall be entitled to terminate this agreement by notice in writing to the other.
